IVolLive Terms of Use

IVOLATILITY'S "IVOLLIVE" OPTION PLATFORM: PURPOSES AND USE AGREEMENT

The following Agreement governs your right to use any of the following IVolLive platform packages (referred below as "IVolLive"): IVolLive Futures, IVolLive Basic, IVolLive Advanced, IVolLive PRO real-time.

Please read it carefully.

Service license use agreement

Notice to the user: this is a license agreement between you and IVolatility.com that governs the right to use IVolLive at rates displayed on a web site if you are:

1. Using data for "Private" use, the following statements apply to you:

  • You enter into this agreement on your own individual capacity and not on behalf of any other person or other legal entity (including employers and fully self-owned legal entities);
  • You are not a security broker-dealer, investment advisor, futures commissions merchant, commodities introducing broker or commodity trading advisor, member of a securities exchange or association of futures contract market, or any owner, partner, or associated person of any of the foregoing;
  • You are not employed by a bank or an insurance company or an affiliate of either to perform functions related to securities or commodities futures investment or trading activity.

2. Student or employee of accredited educational organizations (schools, colleges, universities and similar entities).

Other use cases are considered as Commercial/Professional use, which relates to commerce or general business activity where IVolatility data is used in trading or adding other value on or behalf of businesses or entities. While Private usage refers to personal use only.

For Commercial/Professional use of IVolLive, please contact sales@IVolatility.com to discuss professional license arrangement to use IVolLive for this purpose.

IVolLive is intended as a display service with ability to download some portions of data through additional "Download" buttons , where available, and additional data might incur or involve an additional charge. Automated "grabbing" of data from IVolLive is not allowed and its closely monitored.

You can use screenshots of IVolLive data (charts, portions of tables with data, or any other screens) to share with third parties via social network/blogs, or use in articles, or any kind of PDF reports that you may need to create. Reference to IVolatility.com is required for all pictures that are derived from IVolLive products or services.

Any other distribution of data from IVolLive in any form, unless it is negotiated and permissioned by IVolatility.com, is not allowed.

The IVolLive PRO real-time subscription is subject to exchange fees if you are qualified as a "Professional" customer by exchanges. All such Professional customers should sign exchange agreements and pay exchange fees. Please contact us to provide you with papers and assist in arranging this.

Services are intellectual property of IVolatility.com. All rights not specifically granted to you hereunder by this Agreement are reserved for IVolatility.com. You are hereby granted the non-exclusive right to use one service at a time, and agree not to share your account with any other people. You shall not modify Services, alter, adapt, merge, decompile, disassemble or reverse engineer the program. This license may only be modified or amended in writing, signed by you and IVolatility.com. This license will be terminated automatically if you violate any of its terms, and may be otherwise terminated by IVolatility.com for cause upon written notice to you. This license constitutes the parties' final, complete, and exclusive agreement with respect to the Services.

Services are provided "as is" without warranty of any kind, either expressly or implied, including but not limited to any implied warranty of title, non-infringement, merchantability or fitness for a particular purpose, regardless of whether IVolatility.com has reason to know of your particular needs. In addition, neither IVolatility.com nor any other person makes a warranty that the program will be uninterrupted or error-free. You are solely responsible for your use of the Services.

In no event will IVolatility.com or any other person be liable to you for damages including, without limitation, any loss of profits, loss savings, damage to data or other incidental consequential damages arising out of the use or performance of the Services, even if IVolatility.com or any other such person has been advised of the possibility of such damages, or for claim by any third party.

Services are provided with Restricted Rights. Use, reproduction, or disclosure by the U.S. government is subject to the restrictions set forth in section 52.227-19(C) of FAR. Services are property of IVolatility.com, Derived Data LLC, a Delaware limited liability company located at 2801 Centerville Road, 1st floor, PMB #610, Wilmington, DE 19808-1609.
